by ELDI GmbH, FN 156211 y, and ELDI s.r.o., ICO 36173231, (referred to hereunder as „ELDI“respectively „Garantor“)

For products according to the attached product description statements – belonging to the product group E2K – and according to the present warranty statement ELDI herewith grants a warranty for a period of 20 years after date of invoice for E2K patch cords, E2K fibre pigtails and for patch panels fitted with E2K fibre pigtails and/or E2K connectors which covers the entire assembled system regarding its faultless functioning and declared properties. The present warranty statement only applies to direct purchasers of said products/systems.

The warranty statement shall always apply to the ELDI affiliate involved and its direct purchaser for the specific contract or purchase concerned.

The warranty shall only be applicable for products sold by the Garantor in an assembled state and for said assembled state. Should, for example, an E2K fibre pigtail be assembled or processed further in any possible way by the purchaser or a third party at the end without fitted E2K connector, this specific assembly or processing shall not be covered by the warranty.

Each product is fitted with a batch number which shows the year and month of production. This batch number must be clearly readable on the product for which the warranty claim is issued. Additionally, the invoice issued for the referenced product must be submitted.

The claimed (assembled) product has to be sent carriage paid to the ELDI affiliate concerned. The entitlement to the warranty claim will be assessed within a period of six weeks after receipt. The defect must be described in writing. The invoice must be presented either in original or scanned form. In case the claim has been assessed as legitimate, the Garantor will confirm the acceptance of the warranty claim case within this period. Once the confirmation has been issued, the indemnification for the claimed material will be effected.

Indemnification shall be effected either

– By repairing the faulty material and returning of the product carriage free to the customer , or
– By replacing the claimed product and sending it carriage free to the customer or
– By refunding the amount for which the product has originally been acquired.

The choice of the compensation method rests with ELDI.

The warranty claim is considered to have been placed in a timely manner if the claimed product arrives at the ELDI premises concerned within the declared warranty period of 20 years after date of invoice. ELDI shall not assume liability for any damages incurred by the warranty case.

1. Place of jurisdiction for any legal disputes in the framework or in connection with the present warranty statement including the question if the warranty claim is actually justified and/or applicable shall be without exception the functionally and locally competent court in Vienna, Austria.

2. The present warranty statement shall be exclusively governed by the material law of the Republic of Austria, under exclusion of the law of conflicts .

3. Any changes or amendments to the present warranty statement must be done in writing. Oral or ancillary agreements shall be ineffective.
