Data protection

With this data protection notice, we, ELDI GmbH, FN 156211y, Will-brandtgasse 5, 1190 Vienna, and ELDI, s.r.o, Račianska 66, 83102 Bratislava, Slovakia. (hereinafter jointly and individually referred to as “ELDI”), explain which and how your personal data is processed. We operate the websites euroclust.com, eldi.biz and patchassist.com.

1. Category of personal data processed and legal basis

Wir verarbeiten die Folgenden Ihrer personenbezogenen Daten für die Erfüllung von Verträgen mit Ihnen oder zur Durchführung vorvertraglicher Maßnahmen, sowie für Informations- und Marketingzwecke, die auf Ihre Anfrage erfolgen (Art. 6 Abs. 1 lit. b GSGVO) wenn Sie uns diese Daten bekanntgeben oder aufgrund eines berechtigten Interesses (Art. 6 Abs. 1 lit. f DSGVO):

  • Birth data
  • Company name
  • Company register number and VAT number
  • Address
  • Contact person
  • Country
  • Phone number
  • E-mail address
  • Payment data
  • Contract data
  • Other personal data necessary for the performance of the contract in individual cases
  • Other personal data transmitted for application purposes

Personal data is only collected if it is necessary for the performance and processing of our services or if you have provided it to us voluntarily.

2. Data processing purposes

Your personal data mentioned under point 1 “Processed category of personal data and legal bases” will be processed for the following purposes.

  • processing of inquiries in connection with our activities
  • provision of contractual and pre-contractual services
  • participation, organization and implementation of events in connection with our activities
  • receipt and evaluation of applications
  • optimization of our services and marketing
  • administration and organization of the company

You provide your personal data voluntarily. However, we can only process your requests if you provide the personal data required for the respective purpose.

3. Transmission of personal data

We will transfer your personal data to the following recipients for the purposes mentioned in point 2:

  • The data is generally processed within the company
  • Suppliers
  • Advisors, such as tax consultants
  • Our IT service providers
  • Other external service providers
  • Cooperation partners / partner companies

In order to fulfill the contract with you, it may also be necessary to forward your data to other third parties. Your data will only be forwarded on the basis of the GDPR, in particular to fulfill your order, and some of the above-mentioned recipients of your personal data are located outside your country or process your personal data there.

The level of data protection in other countries may not be the same as in Austria. However, we only transfer your personal data to countries for which the EU Commission has decided that they have an adequate level of data protection or we take measures to ensure that all recipients have an adequate level of data protection, for which we conclude standard contractual clauses.

5. Use of cookies

A cookie is a file that can be stored on your device when you visit a website. They are generally used to offer certain functions (e.g. improved navigation or storage of settings). Cookies do not access or process any other data and most cookies are automatically deleted as soon as you leave the website.

However, persistent cookies are also used, which are stored on your device until they are manually deleted in the browser. We use such persistent cookies so that we can recognize you as soon as you visit the website again, and you can influence the use of cookies on your device.

6. Storage period

We will only retain your personal data for as long as we reasonably deem necessary to achieve the purposes set out in point 2 and in accordance with applicable law. The personal data will be stored at least for statutory retention obligations or as long as the limitation periods for any legal claims are open.

Your personal data is protected by appropriate organizational and technical precautions. These precautions relate in particular to protection against unauthorized, unlawful or accidental access, processing, loss, use and manipulation. Notwithstanding our efforts to maintain an appropriately high level of due diligence at all times, it cannot be ruled out that information that you disclose to us via the Internet may be viewed and used by other persons. Please note that we therefore accept no liability whatsoever for the disclosure of information due to errors in data transmission not caused by us and/or unauthorized access by third parties (e.g. hacking of email accounts or telephones, interception of faxes).

8. Your rights regarding your personal data

Among other things, you have the following rights with regard to your personal data in accordance with the applicable legal situation:

  • Right of access: You have the right to obtain from us confirmation as to whether or not personal data concerning you is being processed, and, where that is the case, access to the personal data and further information and a copy of the personal data.
  • You have the right to request the rectification, completion or erasure of your personal data if it is inaccurate, incomplete or not processed in accordance with the law.
  • You have the right to demand that we restrict the processing of your personal data.
  • You have the right to data portability, i.e. to receive the personal data concerning you, which you have provided to us, in a structured, commonly used and machine-readable format and to transmit those data to another controller to whom the personal data have been provided.
  • Under certain circumstances, you may object to the processing of your personal data and withdraw your consent to the processing of personal data. The revocation does not affect the legality of the processing carried out on the basis of the consent until the revocation.
  • You have the right to lodge a complaint with the Austrian Data Protection Authority.
